PARK RULES

 It is the caravan park operator's duty to ensure that the caravan park rules are reasonable and to take steps to ensure that they are observed by all occupants and are enforced and interpreted consistently and fairly. The following rules have been established by the caravan park operator in the belief that they are reasonable and conducive to the effective management of the caravan park. If an occupant believes that a rule is unreasonable then they should discuss the matter with the caravan park operator.

GENERAL DUTIES

These rules forms part of any agreement between the caravan park operator and any occupier.

1. Occupants use of the site:

The occupants must use the site only for the purpose agreed with the park operator; and use the site, caravan park and facilities properly and ensure that their visitors do the same. Persons under the age of 18 years are not to stay overnight without appropriate adult supervision. No business is to be operated within the caravan park.

2. Number of persons occupying site:

The occupants must not allow more than the number of persons agreed with the caravan park operator to occupy the site. Caravan park operators have the right to require patrons who encroach beyond the sites/s they have paid for to pay extra site fees or will be required to remove obstacles from the other site immediately.

3. Occupants duty to pay rent:

The occupants must pay the site fees and any other charges agreed with the caravan park operator on the due dates and in agreed manner. The person whose name appears on the booking form or registration form is responsible for ensuring compliance with the rules and booking conditions by all members of their party. Sites can not be sub-let to others.

4. Quiet enjoyment - occupants duty:

Occupants must not do anything in or near the site or caravan park, or allow their visitors to the caravan park or site to do anything which interferes with the privacy and peace and quiet of other occupants of the caravan park, or their proper use and enjoyment of the caravan park.

5. Occupants must keep site clean:

The occupants must keep the site clean and tidy; and maintain the site and caravan in a manner and condition that do not detract from the general standard of the caravan park as set by the caravan park operator.

6. Occupants must not erect structures:

Occupants must not erect any structure on the site or in the caravan park without the prior consent of the caravan park operator.

7. Occupants must notify owner of and compensate for damage:

If any damage other than fair wear and tear is caused to the caravan park or any facilities in the caravan park by the occupant or his or her visitor, the occupant must:

a. repair the damage; or

b. notify the caravan park operator or caravan owner of the damage and pay compensation for the damage to the caravan owner or the caravan park operator.

The occupants must report to the caravan park operator any damage to or breakdown of caravan facilities of which the occupants have knowledge.

8. Occupants must not use site for illegal purposes:

The occupants must not use or permit the use of the site, the dwelling or the caravan park for any purpose that is illegal at common law or under an Act. This includes but not limited to illegal drug use, excessive use of alcohol, or unruly or unsavoury behaviour. Offensive or loutish behaviour will not be tolerated; offenders and family may be immediately evicted, with no refund.

9. Occupants must observe caravan park rules:

The occupants must observe all current caravan park rules.

Section A. RULES APPLICABLE TO ALL OCCUPANTS.

All caravan park occupants must, with respect to:-

Right of entry

Management reserves the right to refuse entry to the caravan park of any person at any time without stating a reason and has the authority to remove, or have removed any person for breach of park rules. The park also has the right to reallocate a site if the need arises.

Office hours

1pm – 6pm, 7 days per week

Check in times

  • You must NOT go to your site unless you have booked in at reception.
  • All monies owed will be paid IN FULL prior to occupying your site.
  • Sites are not available for occupancy before 1pm unless you have prior approval from Management.
  • Late check-ins for cabins can be arranged with Management at time of booking. A surcharge may apply should you not advise Management when you make your booking.
  • Bookings for all sites and accommodation are to be made before 6.00pm on the day the accommodation is required. No bookings will be taken after that time for accommodation for that night. The park will be considered closed out of respect for all people currently on site.  No sites will be admitted after 6:00pm close of office.

Check out times

Departure time is before 10.00am on the day of departure. Patrons who depart after 10.00am should make prior arrangements with the Managers. Late departure fees can apply.

The site / cabin must be left in a clean and tidy manner. Cleaning fees may apply if the site / cabin are left untidy or dirty.

Refunds:

Refunds of deposits and fees paid are not available under the following circumstances:

  • Campers who arrive late, do not show up, or leave the park early are not entitled to a refund
  • Inclement weather is not a circumstance for a refund.
  •   Deposits will be refunded:
    • Where at more than 7 days notice of cancellation has been given, prepayments will be refunded less a $25.00 cancellation fee
    • Where 7 days or less notice has been given for cancellations, deposit is forfeit.

A1 The making and abatement of noise.

A1.1 keep noise to a minimum at all times ensuring that there is no unnecessary noise between 10.00pm and 8.00am. Exceptional circumstances may exist where the caravan park operator considers it reasonable that this rule need not be strictly applied. The prior written consent of the caravan park operator must be obtained in these instances.

Circumstances which come to mind might include special celebrations, group functions and entertainment. Such occasions may be planned by the caravan park owner -or alternatively a caravan park occupant. In the case of latter, full consultation with the caravan park operator is expected such that any parameters may be mutually agreed and the privilege not subject to abuse. At all times the privacy and peace and quiet of uninvolved occupants must be considered.

A2. Vehicles

A2.1 observe the park speed limit which is 10 kmh; that is: fast walking pace or travelling in gear without applying the accelerator. Bicycles also must comply.

A2.2 have only one motor vehicle per site unless the consent of the caravan park operator has been obtained for a second vehicle. Such consent will only be given if: 

a) both vehicles are used by the site occupants, and

b) in the opinion of the caravan park operator, a satisfactory parking place is available.

A2.3 in the absence of prior consent from the caravan park operator, ensure that visitors' cars are parked in the visitors' car park.

A2.4 not carry out repairs to motor vehicles within the caravan park unless an appropriate time and place has been agreed to by the caravan park operator.

A2.5 not bring an unregistered or unroadworthy vehicle into the caravan park without the prior written consent of the caravan park operator.

A2.6 drive or ride vehicles on the roads only.

A2.7 not ride bicycles in the caravan park outside daylight hours.

A2.8 only park their vehicle in place specified by the caravan park operator.

A2.9 All drivers are to be appropriately licensed.

A3 The use and operation of communal facilities.

A3.1 Park patrons use the facilities at their own risk and are responsible for their actions.

A3.2 Smoking is not permitted in any of the park buildings or communal areas. (such as reception, laundry, amenities blocks, BBQ area etceteras) or areas within 5 metres of doorways or designated eating areas.

A3.3 Amenity blocks and the laundry are cleaned daily. Avoid using the amenities or laundry when they are being cleaned; this is for your safety. Your co-operation is sought to allow the cleaners to carry out their duties.

A3.4 not wash dishes in the laundry trough, baths or hand basins.

A3.5 remove washing promptly from the washing machines, dryer or clotheslines upon the completion of washing or drying. (The caravan park operator may remove and store laundry items as a result of non-compliance.)

A3.6 not erect a private clothesline other than a small temporary line which is not within obvious view of other park users. Clothesline to be removed when not in use and must not pose a hazard.

A3.7 ensure you leave the BBQ facilities clean and tidy after use, with no rubbish.

A3.8 acknowledging hazards associated with these areas, wear footwear appropriate to the tasks being performed.

A4. The playing of games and other sporting activities.

A4.1 Bicycles and scooters are only permitted to be ridden in the park (walking pace) during daylight hours and any legally required safety equipment, including appropriate helmet must be worn.

A4.2 NO riding through sites, around or in park buildings or at the entrance to the park.

A4.3 For safety reasons children must be supervised at all times. Children are your responsibility; do not allow them to play near other vans, roads, amenities blocks, BBQ shelter or tanks.

A4.4 Rollerblades, skateboards, noisy or motorised toys are not to be used in the park.

A4.5 Games involving the kicking or throwing of balls or other objects are not permitted in or around the amenities block or within close proximity of a dwelling or building.

A4.6 Do not climb trees, retaining walls, levee bank, buildings or caravans within the caravan park.

A5 Visitors:

ALL visitors must register at reception prior to entering the park. Within reason, occupants' visitors are welcome in the caravan park . Park occupants must accept responsibility for their visitors. There is no charge for day visitors. It is expected that day visitors will vacate the caravan park by 10.00 pm or they will be considered as overnight guests.

Park occupants who anticipate having a visitor stay overnight must, when registering their visitor in accordance with the park rules, pay the appropriate fee. The overnight visitor fee is that which applies to additional occupants of sites or dwellings as set by the caravan park operator.

A5.1 Visitors cars must be left in the Visitor’s car park – no visitors cars are to be on park property unless prior approval has been given by Management.

A5.2 visitors are permitted to bring their pets into the caravan park providing that:

A5.2.1 are kept on leads or under the supervision of a responsible person at all times; and

A5.2.2 do not to cause a nuisance, including noise.

A5.2.3 do not harass other caravan park users.

A5.2.4 Pet owners are responsible for cleaning up after their pets. Visitors that those who fail to adhere to these rules will be asked not to bring their pets into the park.

A5.3 All visitors must vacate the park by 10.00 pm. Any visitor found to be on site after this time will be deemed to have intention to stay overnight and will attract a charge which will be payable immediately.

A6. The supervision at children.

A6.1 maintain sufficient supervision of their children, so as to ensure that the children do not cause a nuisance or inconvenience to other occupants, management or employees of the caravan park.

A6.2 ensure children up to the age of nine are supervised by an adult when using the amenities block.

A6.3 Children who generally misbehave in the caravan park will normally be reminded of what constitutes acceptable behaviour before other action is taken. If a child continues to behave in an unacceptable manner, the caravan park operator reserves the right to impose a reasonable sanction on the child. It is expected, in accordance with the caravan park rules, that parents will support the caravan park operator with respect to any reasonable sanction imposed.

A6.4 Bunk Beds: Australian Standards relate to the use of bunk beds and state that: “Children under the age of 9 years are not permitted to use the top bunk. Also children must no play on top bunk.”

A7 The disposal of refuse.

A7.1 wrap food waste before placing it in the bins.

A7.2 not use the caravan park garbage disposal facilities for the disposal of anything other than normal household refuse.

A7.3 Cleaning or disposal of bulk fish in the park is not permitted.

A7.4 in disposing of garden refuse such as leaves, lawn clippings, branches etc. assist the caravan park operator by either disposing of the refuse themselves or consulting with the caravan park operator as to a convenient place for collection.

A7.5 Recycling bins are to be used for designated recyclables only.

A7.6 Rubbish bins must not be removed from designated areas.

A7.7 Dump Point. See park map for location. Use the dump point to discard waste matter from “porta loos”, motor home and caravan toilets. Do not empty these in our amenity blocks or ensuites. Wash down and leave clean the dump point after your use.

A8 Keeping of pets:

A8.1 not have a pet in the caravan park without first obtaining the caravan park operator's consent with respect to a specific pet.

A8.2 If required, provide the caravan park operator with a written guarantee that their pet does not represent a danger to the health and safety of other park users, in particular young children, who may wander into an animal’s territory.

A8.3 keep their pet under control at all times.

A8.4 not allow a pet to be in or near the park's communal facilities.

A8.5 not allow a pet to enter a hired dwelling without management consent.

A8.6 not allow a pet to be a nuisance or cause distress to other park users.

A8.7 clean up any by-product left by the pet and dispose of appropriately.

A8.8 not leave a dog unattended unless absolutely necessary. If it is necessary, every effort must be made to arrange for someone to monitor the dog’s behaviour and well being. Dogs left unattended must

  1. a) be secured.
  2. b) have access to a shelter and shade.
  3. c) be provided with adequate food and water.

A8.9 do not wash pet bedding nor clothing excessively contaminated with animal fur, hair or bodily excrement in communal laundry.

Failure to comply may result in direction to remove the offending animal.

Securing Your Site:

Whilst Park Operators do their best to ensure a safe and secure environment, visitors to the park are to take care of their possessions the precaution of securing items of value left outside their tent, cabin or caravan. Personal property is your own responsibility. Management takes no responsibility for theft or damage of visitors' or tenants property, caravans, cars or tents, all of which are left at the owner’s risk.

Lost property:

Non-perishable, unoffensive lost property is held for a maximum of 60 days, after which the property is offered to charity or otherwise disposed of.

Mail and phone messages:

Mail can be collected at the office during office hours. Phone messages only of an important nature will be taken on your behalf.

Grievances: use a private, conciliatory approach to the settling of disputes with other occupants, the caravan park operator or any employee of the caravan park.

It is the caravan park operator's policy to listen to or raise grievances in private, during office hours, at the caravan park office or at another time and place by arrangement. There is an expectation that an attempt has been made to resolve any dispute between occupants, in accordance with the park rules, prior to the caravan park owners involvement. The caravan park operator will seek to have disputes settled in a manner acceptable to all concerned but at times will be required to make a judgement with respect to a breach of duty by an occupant. In the case of a non-resident occupier a breach may result in the caravan park operator terminating any agreement to provide accommodation. A breach of duty by a resident will be dealt with in accordance with the relevant provisions of the Residential Tenancies Act.

Trees:

Trees in the caravan park are inspected regularly, branches are still prone to fall from time to time, and persons entering the caravan park do so at there own risk. No responsibility will be accepted for personal or property damage caused by falling trees, branches, or other items.

Open Fires:

Due to fire safety hazards, open fires are not permitted. Only the chimenea provided near the barbecue facilities is allowed.

Chimenea (fire pit):

Operated under adult supervision – fire is dangerous

Do not burn rubbish (eg bottle caps) or offensive smelling material

Do not overload or modify chimenea – if fuel is too big, make the fuel smaller

Do not move the chimenea – it is located with safety in mind

Store fuel neatly away from chimenea – avoid tripping and fire hazards

Know where safety equipment and water is located – fire blanket and extinguisher in barbecue shelter, hose connected on pool side of barbecue shelter, additional water taps near power heads and Big Tree (Site 14).

Ensure fire is extinguished when finished

Evacuation:

In the event of an emergency, make your way to the evacuation assembly point shown on the caravan park map. Patrons should follow instructions provided by the park managers.

Emergency Numbers:

In case of emergency call ‘000’ for Fire, Police or Ambulance. For caravan park related emergency please call 02 6959 2955 and LEAVE A MESSAGE. A Telstra free public telephone is located opposite the caravan park at the Ampol fuel station across the Newell Highway.

FAILURE TO COMPLY WITH ANY OF THE ABOVE OR ANY PARK RULES MAY RESULT IN GUESTS BEING ASKED TO VACATE THE PROPERTY WITH NO REFUND ISSUED.
